Parental Leave Payment Increase

Families with new babies get a boost to their parental leave payments. From 1 July the payment will go from $407.36 per week to $429.74. The rate increases yearly and is a maximum amount.

An employee earning less than the maximum will receive an amount based on average weekly earnings. Payments are made for up to 14 weeks but cease earlier if the employee returns to work before that time. The minimum payment for self-employed parents also increases on 1 July from $120 to $125 per week.

Changes to the Copyright Act 1994

Members may be aware of the recent furore about changes to the Copyright Act 1994. Internet Service Providers ('ISPs') have complained loudly about the implications of changes to section 92A of the Act, which has resulted in the government delaying its implementation. The proposed changes have the potential to have a big impact on employers who allow their employees access to the internet.

90 Day Trial Period

Employment Relations Amendment Act 2008

In force from 1 March 2009, the Act:
Applies to:
Employers who, at the time of taking on a new employee, have 19 or fewer employees ( including part-time and casual employees)

Allows for:
The inclusion in a new employee's employment agreement of up to a 90-day trial period provision. Trial periods can only be entered into once with an employee, and only if the employee has not previously been employed by the employer.

What Is The Minimum Wage?

New minimum wage rates apply from 1 April 2009.

Failure to pay employees in accordance with the minimum wage rates is an offence under the Minimum Wage Act 1983 ("the Act"). Employers can face substantial monetary fines.
