Doing The Work of Striking Workers - just what does this mean?
On 17 May 2010 the majority of the Supreme Court handed down a landmark decision in the case Air Nelson v EPMU on how employers and employees should interpret the strike breaking provision s97 Employment Relations Act 2000 (Performance of duties of striking or locked out employees).
The facts of the case were straight forward. Air Nelson and the EPMU were locked in collective bargaining negotiations which got bogged down. The union exercised their statutory right to take industrial action. That industrial action included not carrying out minor line maintenance work on aircraft – namely inspection, light replacement, and engine compression washes. About 99% of this minor line maintenance work was normally carried out by the striking employees, but some of this work was also done by contractors. So, during the strike, Air Nelson got the contractors to do more line maintenance work. The union claimed that this was a breach of s97 Employment Relations Act 2000 which regulates the performance of duties of striking or locked out employees during a strike.
